NOTICE OF SALE UNDER POWER GEORGIA, EFFINGHAM COUNTY THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the power of sale contained in the Security Deed and Agreement ("Security Deed") dated July 2, 2025 from KENT C. RAHN to Thomas E. Rushing, and filed for record on July 2, 2025, and recorded in Deed Book 2982, Page 154, in the office of the Clerk of the Superior Court of Effingham County, Georgia (initial co-borrower Reagan D. Deal having been released from liability under the Security Deed pursuant to that certain Partial Release of Security Deed dated January 8, 2026 and recorded in Deed Book 3018, Page 23, aforesaid records), the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse in Effingham County, Georgia, on the first Tuesday in June, 2026, to the highest bidder for cash, the following described real property: All that certain lot, tract or parcel of land situate, lying and being in the 11th G.M. District, Effingham County, Georgia, containing Four (4) acres, more or less, known and designated as Parcel 4, of the lands of Frank B. Seckinger Estate, that is shown and more particularly described on that certain map or plat made by Paul Weitman, County Surveyor, dated November 4, 1969, recorded in Surveyor's Book I, Page 370, in the records of the Clerk of Superior Court of Effingham County, Georgia. For a more particular description reference is hereby made to the aforesaid plat, which is specifically incorporated herein and made a part hereof. This being the same property conveyed by Limited Warranty Deed With Right of Survivorship from Thomas E. Rushing to Kent C. Rahn and Reagan D. Deal dated July 2, 2025, and recorded in Deed Book 2982, Page 152, Effingham County, Georgia records, and further conveyed by that certain Quitclaim Deed from Reagan D. Deal to Kent C. Rahn dated January 6, 2026, and recorded in Deed Book 3017, Page 661, aforesaid records KNOWN AS: 2185 Highway 119 N, Springfield, GA 31329 PARCEL # 04080028 The debt secured by said Security Deed is evidenced by a Note dated July 2, 2025, in the original principal amount of Two Hundred Thirty-Seven Thousand Five Hundred Fifty and No/100 U.S. Dollars ($237,550.00), with interest thereon as set forth therein, executed by in favor of Thomas E. Rushing, payable, with principal and interest as described in the Note, at the rate of interest as described in the Note, on the unpaid balance until paid. The debt secured by said Security Deed and evidenced by said Note has been and is hereby declared due and payable and the total balance of the debt is therefore declared due and the Security Deed foreclosable according to the terms of the Security Deed and the Note. The debt remaining in default, this sale will be made for the purpose of paying said indebtedness including all accrued and unpaid interest thereon and attorney's fees and all expenses of said sale. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, easements, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best of the undersigned's knowledge and belief, said property is also known as 2185 Hwy 119 N., Springfield, Georgia 31329 (Effingham County, GA PIN: 04080028), and the party in possession of the property is Kent C. Rahn, pursuant to that certain Limited Warranty Deed With Right of Survivorship from Thomas E. Rushing to Kent C. Rahn and Reagan D. Deal dated July 2, 2025, and recorded in Deed Book 2982, Page 152, Effingham County, Georgia records, and further conveyed by that certain Quitclaim Deed from Reagan D. Deal to Kent C. Rahn dated January 6, 2026, and recorded in Deed Book 3017, Page 661, aforesaid records. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with legal requirements and the terms of said Security Deed and Note. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
