STATE OF GEORGIA COUNTY OF EFFINGHAM NOTICE OF SALE Because of default in the payment of a Fixed Rate Note secured by a DEED TO SECURE DEBT, executed by TRACY FALLAW BROOKS AND NORMAN POWELL BROOKS to BANK OF NEWINGTON, dated December 20, 2019 and recorded in Deed Book 2564, Pages 482-492, Effingham County Records, the undersigned has declared the full unpaid amount of the indebtedness referred to due and payable and, acting under the POWER OF SALE contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in November, 2025, during the legal hours of sale at the courthouse in said county, sell at public outcry to the highest bidder for cash, the lands described in said deed, to wit: All that certain lot, tract or parcel of land situate, lying and being in the 1559th G. M. District, Effingham County, Georgia, 0.87 of an acre, more or less, known and designated as Lot 18, Foxbox Farms Northwest, Phase 1, that is shown and more particularly described by the plat of survey made by Lamar O. Reddick, RSL, dated November 2, 1983 recorded in the Office of the Clerk of the Superior Court of Effingham County, Georgia in Plat Book 16, page 111; and a plat made by Warren E. Poythress, RLD #1953, dated January 11, 1996, recorded in Plat B, Cabinet A, Slide 342B, aforesaid records, that are incorporated into this description by specific reference thereto. This being the same property conveyed by Lorwill Land Corp. and Armstrong Construction Co., Inc. to Elbert Thompson, Sr. and Gwendolyn D. Thompson as evidenced by that certain Warranty Deed dated March 27, 1984 and recorded in Deed Book 217, page 713, aforesaid records. Further conveyed by Certificate of Order of Years Support dated August 19, 2019, Elbert Thompson, Sr., deceased, to Gwendolyn D. Thompson recorded in Deed Book 2541, page 348, aforesaid records. Grantor declares that the wheels, axels, and hitches have been removed and that the mobile home is connected to the utilities. Grantor intends that the mobile home lose it nature as personal property and become real property. Said mobile home shall be hereafter considered permanent fixture on the realty and henceforth title to said mobile home shall be considered as merged with title to the realty. Said property will be sold, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to security deed held by the undersigned.
