NOTICE OF SALE UNDER POWER CONTAINED IN SECURITY DEED STATE OF GEORGIA COUNTY OF EFFINGHAM Pursuant to a power of sale contained in a certain security deed executed by Dalton Kirby, hereinafter referred to as Grantor, to Mortgage Electronic Registration Systems, Inc. as nominee for Loandepot.com, LLC recorded in Deed Book 2528, page 189, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said security deed, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said security deed and note secured thereby) will sell at the usual place of conducting Sheriff's sales in said county within the legal hours of sale, to the highest bidder on the first Tuesday in October 2025, all property described in said security deed including but not limited to the following described property: All that certain lot, tract or parcel of land situate, lying and being in the 1559th GM District of Effingham County, Georgia, known as Lot Sixteen (16), Block A, Lakeside Farms, Phase One (1), and being bounded on the North by a lake, on the East by Lot Fifteen (15), said Block and Phase, Lakeside Farms, on the South by the public road known as Community Road, and on the West by Lot Seventeen (17), said Block and Phase, Lakeside Farms, all as is more fully shown and delineated upon a plat dated February 6, 1969, prepared by Lamar O. Reddick, Georgia registered surveyor no, 1387, as recorded in the office of the Clerk of the Superior Court of Effingham County, Georgia, in plat record Book 4, Page 138, which plat by reference is incorporated herein as a part of this description property commonly known as 129 Community Road, Bloomingdale, Georgia 31302 and having a pin no of 0377A-016-A00. This conveyance is executed and delivered subject to all valid restrictive covenants, easements and rights-of-way of record. This being the same property as conveyed by executor's deed under power from Shirley E. Watson, as executrix of the last will and testament and codicil of Carrie Mae Harry, deceased, late of the state of Georgia, and County of Chatham, to Shirley E. Watson, of the state of Maryland, now deceased as of July 8, 2015, dated November 2, 1993 and recorded December 2, 1993, in Deed Book 346, Page 428, in the office of the Clerk of the Superior Court of Effingham County, Georgia. Said legal description being controlling, however, the Property is more commonly known as: 129 Community Road, Bloomingdale, GA 31302 Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Security Deed.
