NOTICE OF FORECLOSURE SALE UNDER POWER EFFINGHAM COUNTY, GEORGIA Under and by virtue of the Power of Sale contained in a Security Deed given by David Levi Love, Jr. aka David L. Love, Jr. to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Branch Banking and Trust Company, dated March 19, 2008, and recorded in Deed Book 1736, Page 27, Effingham County, Georgia Records, as last transferred to Truist Bank by assignment recorded on June 7, 2024 in Book 2913 Page 562 in the Office of the Clerk of Superior Court of Effingham County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Ninety-Seven Thousand and 0/100 dollars ($97,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Effingham County, Georgia, within the legal hours of sale on May 6, 2025, the following described property: All that certain lot, tract or parcel of land situate, lying and being in the 10th G.M. District, Effingham County, Georgia, being known as Lot 39, Pine Hill Estates Subdivision, Phase IV, as shown and more particularly described on that certain map or plat made by Warren E. Poythress, R.L.S. #1953, dated October 17, 1989, recorded in Plat Record Book 23, Page 253, in the records of the Clerk of Superior Court of Effingham County, Georgia. For a more particular description reference is hereby made to the aforesaid plat, which is specifically incorporated herein and made a part hereof. Interest conveyed by this Deed shall also include all rights, title and interest in that certain make and year mobile home described as one 2007 Southern Manufactured Home, Model No. ES328, bearing serial number DESAL3809A and DESAL3809B. Grantor/Grantee declares that the above described mobile home will remain permanently affixed to the property and will be treated as a fixture. Grantor/Grantee also declares that the wheels, axels, and hitches have been removed and that the mobile home is connected to the utilities. Grantor/Grantee intends that the mobile home lose its nature as personal property and become real property. Said mobile home shall be hereafter considered a permanent fixture on the realty and hencforth title to said mobile home shall be considered as merged with title of the realty. This being the same property conveyed by Quitclaim Deed from Kristina K. Hall to David L. Love, Jr., dated March 18, 1994, recorded in Deed Book 355, page 728, aforesaid records. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
